O.S. 1045/03 (Tel Aviv) Kfir Constructions Ltd. v. Elscint Ltd. et. al.

The District Court of Tel-Aviv held that in the absence of use of the graphic elements of a registered trademark, the use of parts of the trademark does not constitute infringement. Even more so, when the part used is a generic word. The Court further held that in order to prove goodwill and secondary meaning acquired by using generic words, the arguing party should produce evidence showing extensive use of the words.
